Manual Screenshots: Authorized users may manually capture screenshots of detected litter for documentation purposes. These screenshots are stored locally within your organization's infrastructure and are not automatically captured.
Detection Metadata: Information about detected litter including location coordinates, timestamps, litter counts, and density measurements.
User Account Information: Basic details about system users such as usernames, encrypted passwords, contact information, and access permissions needed for system operation.
System Logs: Technical information about system usage, including login records, detection sessions, and error logs to ensure system integrity and troubleshooting.

How We Use Your Information

The information we collect is used exclusively for legitimate purposes related to environmental management:

Litter Management: Identifying areas requiring cleaning services and optimizing waste management resource allocation.

Welcome to TrashScan Surveillance System. By accessing or using our application, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding with the use of our system.

Definitions

For the purpose of these Terms and Conditions:

"System" refers to the TrashScan Surveillance System software, including all its components and functionalities.
"User" refers to any individual or entity with authorized access to the System.
"Organization" refers to the entity (such as a municipality, government agency, or private organization) that has deployed the System.
"Detection Data" refers to information collected and processed by the System regarding litter detection.
"Manual Screenshots" refers to image captures initiated by Users for documentation purposes.

License Grant

TrashScan Surveillance System grants the Organization a limited, non-exclusive, non-transferable license to:

Install and use the System on computing devices owned or controlled by the Organization
Use the System for environmental monitoring and waste management purposes within the Organization's jurisdiction
Create and manage User accounts for authorized personnel
Store and process Detection Data in accordance with applicable laws and regulations

This license is valid for the duration specified in your contract or service agreement and is subject to your compliance with these Terms and Conditions.

Usage Restrictions

You agree not to engage in any of the following prohibited activities:

Use the System in any manner that violates applicable local, state, national, or international laws or regulations
Use the System for surveillance of private property without proper legal authorization or consent
Use the System for facial recognition or tracking of individuals
Attempt to decompile, reverse engineer, disassemble, or hack the System
Modify, adapt, or create derivative works based on the System without written authorization
Remove, alter, or obscure any proprietary notices on the System
Share access credentials with unauthorized users or allow unauthorized access to the System
Use the System to harass, abuse, or harm another person, or in a way that is threatening, abusive, defamatory, or otherwise objectionable
Use the System to violate the privacy rights of any third party
Interfere with or disrupt the System or servers or networks connected to the System

User Accounts and Security

Organizations are responsible for:

Creating and managing User accounts for authorized personnel only
Ensuring the confidentiality of all login credentials
Implementing appropriate access controls based on User roles
Promptly deactivating accounts of personnel who no longer require System access
Notifying us immediately of any security breach or unauthorized use of the System

Data Ownership and Usage

The Organization retains ownership of all Detection Data and Manual Screenshots captured through the System. However, you grant us a limited license to:

Access and analyze anonymized detection data for system improvement purposes
Use anonymized statistical information for research and development
Include anonymized performance metrics in aggregate industry reports

We will not access, use, or share identifiable Detection Data without explicit authorization except as required by law.

System Limitations

You acknowledge that:

The System is designed for litter detection and environmental monitoring only
Detection accuracy may vary based on environmental conditions, camera positioning, and other factors
The System is not designed to detect or prevent criminal activity
The System does not continuously record or store video footage
Screenshots are only captured when manually initiated by authorized Users

Updates and Maintenance

We may periodically release updates to improve System functionality, security, or performance. Organizations are responsible for applying these updates in a timely manner according to provided instructions. We may need to temporarily suspend access during scheduled maintenance, and will make reasonable efforts to provide advance notice of any significant maintenance activities.

Warranty Disclaimer

THE SYSTEM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SYSTEM WILL FUNCTION WITHOUT INTERRUPTION OR ERRORS, OR THAT ALL LITTER WILL BE DETECTED WITH 100% ACCURACY.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SYSTEM.

Indemnification

You agree to indemnify, defend, and hold harmless TrashScan Surveillance System and its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms and Conditions, your violation of any law, or your violation of the rights of a third party, including the infringement of any intellectual property rights.

Termination

We reserve the right to suspend or terminate your access to the System for violations of these Terms and Conditions or for any other reason at our discretion. Upon termination:

Your license to use the System will immediately cease
You must uninstall the System from all computing devices
You may export your Detection Data within 30 days of termination

Changes to Terms

We may modify these Terms and Conditions at any time. We will notify you of significant changes through the System interface or by other means. Continued use of the System after such modifications constitutes your acceptance of the modified terms.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Philippines, without regard to its conflict of law provisions.
